Welcome to CLEAR MIND COLORADO, LLC dba “Hobbies™” ("Hobbies," "we," "us," or "our"). These Terms & Conditions (the "Terms") govern your access to and use of our website(s), mobile experiences, and related services (collectively, the "Services"). By browsing or using the Services, you agree to be bound by these Terms and our Privacy Policy (incorporated by reference). If you do not agree, do not use the Services.

NOTICE OF ARBITRATION & CLASS ACTION WAIVER. These Terms contain a binding Arbitration Agreement and Class Action Waiver (see Sections 20–21). They affect your legal rights. Please read them carefully.

1) Eligibility & Age Restriction

  • You must be 21+ to purchase or consume our hemp-derived products.

  • By using the Services, you represent that you are of legal age and have full authority to enter into these Terms.

2) Legal Compliance (2018 Farm Bill)

  • Our hemp-derived products are formulated to contain ≤ 0.3% Δ9-THC by dry weight under the U.S. 2018 Farm Bill.

  • You are solely responsible for understanding and complying with federal, state, and local laws applicable to your purchase and use. We do not guarantee legality in your jurisdiction and may cancel orders where prohibited by law.

3) Health & Safety; No Medical Advice

  • The Services and any product information are for informational purposes only and not a substitute for medical advice, diagnosis, or treatment.

  • Not evaluated by the FDA. Our products are not intended to diagnose, treat, cure, or prevent any disease.

  • Consult your healthcare professional prior to use, especially if pregnant/nursing, taking medication, or having a medical condition. Do not drive or operate machinery after consuming products that may cause drowsiness or impairment. Use responsibly.

4) Description of Services & License

  • Through the Services we offer hemp-derived ingestibles and related goods (the "Products") for one-time purchase or subscription.

  • We grant you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Services for lawful, non-commercial purposes, subject to these Terms. We reserve all rights not expressly granted.

  • You may not: reverse engineer; decompile; create derivative works; copy; distribute; frame; scrape; mine; or otherwise exploit the Services or content except as permitted by these Terms or applicable law.

5) Accounts; Registration; Security

  • Account creation may require accurate contact, shipping, and payment information. Keep your credentials confidential and notify us immediately of unauthorized use.

  • You are responsible for all activity under your account, whether authorized or not. We may refuse, suspend, or terminate accounts in our discretion.

6) Product Information, Availability & Pricing

  • We strive for accuracy but do not warrant that descriptions, labeling, ingredients, imagery, or other content are complete, current, or error-free. If a Product is not as described, your sole remedy is to return (unused) per our Return Policy (Section 9).

  • We may discontinue, limit quantities, or change prices without notice. Taxes and shipping may apply.

7) Orders, Payments & Risk of Loss

  • By placing an order, you authorize us (and our payment processors) to charge your payment method for the full amount (including taxes, shipping, and any applicable subscription charges).

  • Title and risk of loss pass to you upon our delivery to the carrier. Delivery estimates are not guarantees. We are not responsible for carrier delays or events beyond our control.

  • We may refuse or cancel orders (e.g., suspected fraud, regulatory issues, restricted destinations).

8) Shipping & Restricted Destinations

  • We ship within the United States only to jurisdictions that allow hemp-derived products. We may block shipments to certain addresses (e.g., P.O. Boxes or forwarding services) or locations as laws evolve.

9) Returns, Refunds & “Happiness” Guarantee

  • Unless otherwise stated on the Product page, first-purchase 30‑day guarantee: if you are dissatisfied with your first order, contact us at help@getsomehobbies.com within 30 days for instructions. Proof of purchase  may be required. Shipping fees are non-refundable. We are not responsible for items lost/damaged in transit.

  • Subsequent orders, opened consumables, or orders beyond 30 days are generally not eligible for refund, except for delivery damage or our error.

  • Some Products, bundles, promotions, or trial items may be final sale; the Product page will control.

10) Subscriptions; Auto-Renewal; Manage & Cancel

  • You may subscribe to receive recurring shipments at the cadence you select (e.g., 30/60/90 days). Your subscription automatically renews and your payment method will be charged on each renewal at the then-current price until you cancel.

  • We will send renewal reminders consistent with applicable law. Manage or cancel at any time via your account portal before the next renewal to avoid future charges. Cancellations take effect for future periods only. We may suspend or terminate a subscription at any time.

11) Trials, Welcome Offers & Promotional Terms

  • We may offer limited-time trials or welcome offers subject to additional terms disclosed at signup. Unless stated otherwise: (a) one per household/account; (b) no resale; (c) may require enrollment in auto‑renewing subscription that charges after the trial window unless you cancel in time; (d) we may refuse, limit, or cancel to prevent abuse.

  • By participating, you agree to the specific promotional terms at checkout and these Terms.

12) SMS/MMS Mobile Messaging (TCPA)

  • By opting in (e.g., via online form or keyword), you consent to receive autodialed or prerecorded marketing and transactional texts at the number provided. Consent is not a condition of purchase. Message/data rates may apply; frequency varies.

  • Opt‑out: reply STOP to any message; you may receive a confirmation text. For help, reply HELP or email help@getsomehobbies.com. Carriers are not liable for delayed/undelivered messages. Program availability may vary by carrier/device.

  • Age: Mobile messaging is for users 21+ only. Prohibited content includes unlawful, obscene, harassing, discriminatory, or infringing material.

  • The Hobbies mobile message service (the "Service") is operated by Hobbies (“Hobbies”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
  • By consenting to Hobbies’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Hobbies through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

    You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Hobbies. Your participation in this program is completely voluntary.

    We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

    You may opt-out of the Service at any time. Text the single keyword command STOP to or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Hobbies mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

13) User Content; Interactions & Community Standards

  • You are solely responsible for content you submit or share ("User Content"). You agree not to post or transmit content that is illegal, abusive, defamatory, obscene, infringing, or otherwise violates these Terms.

  • We may monitor, remove, or restrict User Content to protect our users, Services, or legal rights. You grant Hobbies a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty‑free license to host, use, reproduce, modify, and display your User Content in connection with the Services and our business.

14) Intellectual Property

  • The Services, including text, graphics, logos, names, images, audio/video, and code are owned by Hobbies or its licensors and protected by U.S. and international laws. Hobbies™ and related marks are trademarks of CLEAR MIND COLORADO, LLC. Do not use our marks without prior written permission.

15) Digital Millennium Copyright Act (DMCA)

  • We respect intellectual property rights. If you believe content on the Services infringes your copyright, send a notice to our DMCA Agent:

    Your notice must include: (a) identification of the copyrighted work; (b) identification of the infringing material and its location; (c) your contact information; (d) a statement of good‑faith belief; (e) a statement under penalty of perjury that the information is accurate and you are authorized; and (f) your physical or electronic signature. Counter‑notices may be submitted per 17 U.S.C. §512.

16) Prohibited Uses; Security

  • You may not misuse the Services, including by: attempting unauthorized access; probing/scanning systems; interfering with service; introducing malware; scraping; spamming; harvesting data; or violating any law. We may monitor and disclose activity to comply with law and protect our rights, users, and the public.

17) Third‑Party Sites & Services

  • The Services may link to third‑party sites. We do not control or endorse them and are not responsible for their content, policies, or practices. Access at your own risk.

18) Compliance & International Use

  • The Services are controlled from the United States. We make no representation that the Services or Products are appropriate outside the U.S. If you access from elsewhere, you do so at your own risk and are responsible for compliance with local laws.

19) Disclaimers

  • AS IS / AS AVAILABLE. The Services and Products are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non‑infringement, accuracy, or uninterrupted/secure operation. Information (including product content and COAs) may change without notice.

  • We do not guarantee any outcome or effect from use of the Products. Some jurisdictions do not allow certain disclaimers; your rights may vary.

20) Limitation of Liability

  • To the fullest extent permitted by law, Hobbies and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, punitive, or consequential damages; lost profits; data loss; business interruption; or cost of substitute goods/services arising from or related to the Services or Products.

  • Our aggregate liability for direct damages will not exceed the amount you paid to us for the Product(s) giving rise to the claim in the three (3) months preceding the event. Some jurisdictions do not allow limitations; your rights may vary.

21) Indemnification

  • You agree to defend, indemnify, and hold harmless Hobbies from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or Products, your User Content, or your violation of these Terms or applicable law.

22) Arbitration Agreement (U.S. Users)

  • Agreement to Arbitrate. Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or Products (collectively, "Disputes") shall be resolved by binding arbitration on an individual basis under the Federal Arbitration Act and administered by JAMS under its Comprehensive Arbitration Rules & Procedures (or Streamlined Rules, as appropriate). Hearings may occur by documents, phone, online, or in person in the U.S. county of your residence.

  • Small Claims. Either party may bring qualifying claims in small claims court.

  • Process & Fees. Each party pays its own arbitration filing/administrative fees per JAMS rules; the arbitrator may award fees/costs if authorized by statute or rule. Judgment on the award may be entered in any court of competent jurisdiction. Nothing limits our ability to seek injunctive relief to protect IP or the Services.

23) Class Action Waiver

  • NO CLASS ACTIONS. Disputes must be brought individually, not as a plaintiff or class member in any purported class or representative proceeding, and the arbitrator may not consolidate claims without all parties’ written consent.

24) Governing Law; Venue (Colorado)

  • These Terms are governed by the laws of the State of Colorado (without regard to conflicts of law). Subject to Sections 22–23, the exclusive venue for any court proceeding shall be the state or federal courts in Denver County, Colorado. You consent to such jurisdiction and venue.

25) Changes to the Services or Terms

  • We may update these Terms and post the revised version with a new “Last Updated” date. Material changes will be communicated consistent with applicable law (e.g., email notice or banner). Continued use constitutes acceptance of the updated Terms.

26) Suspension; Termination

  • We may suspend or terminate your access (or the Services) at any time for any reason. Upon termination, Sections intended to survive (including 12–25) shall do so.

27) Miscellaneous

  • Entire Agreement. These Terms (plus the Privacy Policy and any posted promotional terms) are the entire agreement between you and us regarding the Services.

  • Severability. If any provision is found unenforceable, it will be modified to the minimum extent necessary to be enforceable, and the remainder will remain in effect.

  • No Waiver. A failure to enforce any provision is not a waiver of our rights.

  • Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition, or asset sale.

  • Headings. Headings are for convenience only.
